General terms and conditions

1. General

1.1 These general terms and conditions apply to all agreements between Gokane.nl and the customer.

1.2 By placing an order, the customer agrees to the terms and conditions of delivery and payment.

1.3 Gokane.nl may adjust its delivery and payment terms at any time if its insights change. The terms and conditions applicable at the time of the order will be observed and maintained.

1.4 These terms and conditions apply to every agreement between sportpoeders.nl and the customer who has declared these terms and conditions applicable, unless the parties have expressly deviated from these terms and conditions in writing.

1.5 These terms and conditions also apply to agreements with the customer, for the execution of which third parties must be involved.

1.6 The goods offered are depicted and/or described clearly and truthfully, and as completely as reasonably required, and possess the properties stated by Gokane.nl in the offer. If a product has a limited validity period of less than 3 months, this limitation will be clearly stated.

2. Conclusion of the agreement

2.1 The agreement is concluded when the order is paid for and the conditions set out therein are met.

3. Prices

3.1 As long as the agreement has not been concluded, Gokane.nl is entitled to change the prices and other conditions stated in the online store.

3.2 All prices include VAT and exclude shipping costs, unless stated otherwise.

3.3 All prices are stated in €.

4. Delivery

4.1 Delivery by us will take place at Gokane.nl's registered office by handing over the goods to the carrier chosen by the customer. Gokane.nl may choose to deviate from the chosen carrier in certain situations if this is necessary due to unforeseen circumstances. The customer will be notified of this, and any excess shipping costs will be refunded.

4.2 If part of the order cannot be delivered until a later date, the same shipping method will be used. This may be deviated from if the shipping costs are higher than the cost of the subsequent delivery. In this case, a less expensive shipping method will be used. There are no additional costs associated with subsequent delivery.

4.3 If delivery of an item proves impossible for any reason, Gokane.nl will, in consultation with the customer, refund the amount already paid to the customer.

4.4 Despite all the care we take with orders, it is possible that an order may not be delivered or may be incomplete. In that case, you can report this to us up to 14 days after placing your order, and we will replenish or redeliver the order at our expense.

4.5 If any products are missing from your order, you must notify Gokane.nl immediately. We will investigate, and you are obligated to cooperate and answer any questions asked. This is to report any potential theft of any product(s).

4.6 The customer is obligated to inform Gokane.nl of any change of address. Until we receive a change of address, you are deemed to be residing at your last known address and remain liable for any items you order that were delivered to your old address.

4.7 If you receive items you did not order, you must notify Gokane.nl and cooperate in returning the incorrectly delivered products. We will send you a return label, and the package must be returned. Gokane.nl will select the nearest drop-off location.

4.8 If an order cannot be delivered due to incorrect address information, and additional costs are incurred, these additional costs will be borne by the customer. Sportpoeders.nl assumes that the correct delivery address has been provided and is not liable for any costs arising from incorrect address information.

4.9 If the delivery of a shipment is delayed by the carrier, this is not the responsibility of Gokane.nl. In that case, Gokane.nl will make every effort to have the shipment delivered to the customer as soon as possible, but is bound by the carrier's policy. If a shipment is delayed by more than 3 days, we may initiate an investigation into the missing package with the carrier. Once the carrier's investigation is completed and a shipment is found to be missing, the order will be reshipped at Gokane.nl's expense, or the amount will be refunded.

5. Payment

5.1 You must pay by iDeal, Sofort banking, Mister Cash, Bancontact, PayPal or bank transfer.

5.2 If Gokane.nl allows payment on account, a payment term of 14 days after invoice date applies.

5.3 You cannot offset the payment against claims. You may also not suspend payment for any reason.

5.4 Prepayment is only possible by bank transfer.

5.5 If you fail to pay (on time), you will owe statutory (commercial) interest and all judicial and extrajudicial collection costs, with a minimum of €10. Sportpoeders.nl may then suspend its obligations or terminate the agreement.

5.6 If you do not complete an online payment on time, the order will be canceled by the payment provider. If the customer subsequently pays for the order via bank transfer, sportpoeders.nl must be notified. The order can then be processed again.

5.7 When an order is shipped to a country outside the European Union, import duties and VAT will be charged in the destination country. These costs are the responsibility of the recipient.

6. Retention of title

6.1 Delivered items remain the property of Gokane.nl until you have fulfilled all your (payment) obligations. This applies to all obligations for which the law permits the reservation of title, regardless of the delivered item for which the payment obligation arose.

6.2 Gokane.nl is irrevocably authorized, as soon as the customer is in default of any obligation, to take back from the customer any items that have remained the property of Gokane.nl.

7. Right of return

7.1 The customer has the right to return items delivered by Gokane.nl within 14 business days (the trial period), starting the day after receipt, in the original packaging, along with a copy of the relevant invoice or packing slip, unless otherwise stated due to the nature of the product and packaging. Returned items must not be worn, used, opened, or damaged. The customer must also comply with all return conditions.

7.2 If the items are unused and have been returned on time and correctly, Gokane.nl will refund the amount of the placed order as soon as possible, but no later than 14 days after receipt of the returned items.

7.3 When a product is returned, the customer must pay the costs of the return shipment.

7.4 The right of return does not apply to: items with a broken seal; items that are no longer saleable due to damage; and items whose packaging cannot be checked for opening and/or use.

7.5 The burden of proof that the customer has exercised their right to return within the cooling-off period lies with the customer. In this regard, Gokane.nl accepts a return memo or consignment note stamped or signed by the carrier, proof of mailing, or a similar document.

8 Liability

8.1 Gokane.nl is not liable for any advice it provides, any printing or typographical errors on the website, or any information provided by suppliers or manufacturers. Furthermore, Gokane.nl is not liable for unforeseeable and reasonably uncontrollable poor product quality.

9 Transport risk

9.1 Gokane.nl bears the risk of damage and loss of the items during transport. After the items have been received by the customer, the risk of damage and loss passes to the customer.

9.2 In the event of a return, the customer bears the transport risk. After Gokane.nl has received the items, the risk of damage and loss passes to Gokane.nl.

9.3 If one or more items are lost during transport from Gokane.nl to the customer, the customer agrees to cooperate with the investigation upon first request. If this obligation is not met, Gokane.nl is entitled to recover the price of the items from the customer.

10. Disputes

10.1 Dutch law applies to all agreements between Gokane.nl and the customer.

10.2 In legal proceedings between Gokane.nl and the customer, the Dutch court has jurisdiction and, if and to the extent that statutory provisions do not oppose this, the court in the district where Gokane.nl is established has jurisdiction, unless Gokane.nl chooses the court of the customer's place of residence or place of business.

11 Privacy

11.1 Customers' personal data is stored in our customer system to ensure fast and smooth order processing. Naturally, we comply with applicable laws and regulations when using your personal data. Gokane.nl uses customer data for (internal) marketing purposes, such as sending newsletters.

11.2 Gokane.nl will never (without legal reasons, or outside the purpose of its processing) pass on your data to third parties.

12 Use

12.1 Always consult your doctor before using nutritional supplements if you are taking any prescription or over-the-counter medications or if you have a medical history including but not limited to: high or low blood pressure, heart rhythm disorders, stroke, heart, liver, kidney or thyroid disease, epilepsy, mental health conditions, diabetes, difficulty urinating due to an enlarged prostate or if you are taking antidepressants or any other medication.

12.2 Discontinue use and consult your doctor if you experience any adverse effects from taking any dietary supplement.

12.3 Never exceed the recommended dosage. DO NOT use a product if the safety seal is open or missing.

12.4 Products purchased from Gokane.nl should always be kept out of reach of children and (domestic) animals.

12.6 User assumes all risks, responsibilities, and consequences related to the use of products purchased on Gokane.nl.

13 Other Provisions

13.1 The content of these terms and conditions, as well as the content of all other Gokane.nl publications, whether online or otherwise, has been compiled with the utmost care. However, Gokane.nl cannot provide any guarantees regarding the nature, accuracy, or content of this information. Gokane.nl is not liable for any errors or inaccuracies, nor for the consequences of using this information.
